Hello all,
A quick reminder that the West Sacramento City Council will vote tonight on a moratorium on dispensaries -Hope you all can make it! Here are the details:
NO 344 PUBLIC NOTICE CITY OF WEST SACRAMENTO NOTICE OF HEARING The West Sacramento City Council will consider the following matter on Wednesday, July 8, 2009, at West Sacramento Civic Center, City Council Chambers, 1110 West Capitol Avenue, West Sacramento, California, at 7:00 p.m. or as soon thereafter as the matter may be heard: Public Hearing on Adoption of Interim Urgency Ordinance Establishing a Moratorium on Medical Marajuana Dispensaries This item is a public hearing on City Council's adoption of an interim urgency ordinance that will establish a citywide moratorium on the issuance of all discretionary permits or entitlements for medical marijuana dispensaries.

Sacramento City Council Moratorium

A moratorium will be on the agenda of the Law and Legislation Committee next week, Tuesday June 16th at 3pm. This will be at City Hall, 915 I Street, 1st Floor in the Council Chambers - Please show up to support!
The Staff Report on dispensaries is not available yet, but will be posted online by the end of the day at: http://sacramento.granicus.com/ViewPublisher.php?view_id=8
Reading through the Staff Report, I can't say that I share your optimism here... There isn't much in the report, but there are these sections:
"Currently The City does not allow medical marijuana dispensaries under the
current zoning code. Therefore, business operations tax certificates to own or operate a medical marijuana dispensary, collective or cooperative are not issued
by the City. Consequently, the City does not recognize any business use or form
for the distribution and/or sale of medical marijuana and any business (profit or
non-profit) operation that is distributing medical marijuana is subject to enforcement and closure."
"Policy Considerations: Presently, the City's zoning code does not recognize or allow medical marijuana dispensaries to operate in the City. In light of the
public safety and quality of life for our citizens, staff is seeking policy direction
from the Committee on whether to affirmatively prohibit or ban marijuana
dispensaries or regulate the distribution and use through amendments to the
zoning code and business license and regulations to be consistent with State law."
"Some commentators have noted that in light of the restrictive and burdensome requirements set forth in the guidelines virtually all of the existing
medical marijuana dispensaries operating in California are violating state law."
